Russian President Vladimir Putin introduced to the State Duma a draft federal constitutional law, which cancel the need to notify the Secretary General of the Council of Europe on the introduction or termination of military or emergency provisions in the Russian Federation. The document is posted in the Duma electronic database.
In particular, we are talking about amendments to Article 22 of the Law “On Martial Profit” and Article 37 of the Law “On Emergency”.
current norms establish that in the case of martial law in the territory of the Russian Federation or in certain regions, the president takes measures to notify the UN Secretary Generals and European Councils on the retreat of the Russian Federation from its obligations under international treaties related to the restriction of the rights and freedoms of citizens. In the case of a state of emergency, such informing is included in the responsibility of the Russian Foreign Ministry. Also, the UN and the Council of Europe are informed in case of termination of military or emergency provisions.
New norms propose to exclude points from the laws about informing the Secretary General of the Council of Europe and to maintain the provisions of the Regulations only on informing the UN Secretary General. In addition, it is also proposed to exclude the norm from the law “On Emergency Status” that international obligations assigned to the Russian Foreign Ministry follow from the Convention on the Protection of Human Rights and Fundamental Freedoms.
Earlier, the official representative of the Russian state was published on the official portal of legal information, according to which the deputy head of the Ministry of Foreign Affairs of the Russian Federation Alexander Grushko, the official representative of the President, was appointed by the President’s official representative.
Russia has been part of the Council of Europe since 1996 and left it in March 2022.
