The lawyers of the ex-president of Georgia Mikhail Saakashvili decided to postpone an appeal to the European Court of Human Rights (ECHR) until the decision of the Tbilisi Court of Appeal in the case of the abolition or postponement of punishment for their client.
This was told to reporters by human rights activist Shalva Khachapuridze.
“The consideration of such lawsuits in the Tbilisi Court of Appeal is held in such a short time that at this stage we refrain from filing a lawsuit in the ECHR,” said Khachapuridze.
At the same time, he did not rule out that the appeal can bring the result.
“We will wait for the Tbilisi Court of Appeal and make a corresponding decision. In any case, today the reality is such that it is possible that the Tbilisi Court of Appeal will change this decision,” said Khachapuridze.
The basis for such assumptions is the diagnosis of Saakashvili “Cachexia”, which was made to the ex-president in the Vivamedi clinic, where he is undergoing treatment, he noted.
“Saakashvili was refused on the basis of the testimony of Nino Nadiradze (the director of Vivamedy – Ed.) – supposedly Saakashvili does not want to eat. At the same time, the Vivamedi clinic itself confirmed the diagnosis of Cahexia, which was made by Georgian and American experts. Accordingly, the Tbilisi City Court relied on false information, ”said Khachapuridze.
According to him, the diagnosis of Caexxia is the basis for delaying or canceling the sentence according to the order of the Minister of Health.
At the same time, the lawyer noted that if the Tbilisi Court of Appeal decides to delay, Saakashvili will go abroad for treatment.
“In the event of a deferral, his immediate transfer to treatment will occur. Several European countries expressed their readiness to send a special medical aircraft, and it will be sent to leading European clinics,” Khachapuridze noted.
At the same time, he noted that lawyers have an action plan and in case of refusal, the defense will not yet voice it, but in intentions – to exhaust all the resources of a legal decision within the country.
Tbilisi City Court on February 6 refused Saakashvili to release or postponement of punishment for health reasons. The defense insisted that the ex-president of the dementia was unspecified, cachexia and a pronounced atactical syndrome, accompanied by the destruction of mental functions, which is the basis for liberation. A special penitentiary service called these diagnoses inaccurate.
